I recently booked a flat under construction, paying around 10-11 lakhs through cheques. I also gave separate cheques for income tax and service tax. Now, I want to cancel the booking, but the builder is charging a 50,000 cancellation fee and refusing to refund the service tax and income tax, which amounts to roughly 1 lakh. I have all the payment receipts from the builder. The booking agreement didn’t mention any cancellation charges. What are my legal options? How do I proceed with this situation?

My grandfather passed away 40 years ago. My father and his siblings divided the property, selling most of their shares. We received what was left. Now, my aunts, who are 80 and 70 years old, and have been married for 64 and 50 years respectively, are claiming a share in my grandfather’s property. Can they do this after so many years? I bought a shop from someone who got it from the builder. However, the blueprint shows it as stilt parking, and I only found out later. The society has received its occupancy certificate (OC), and I even paid stamp duty and registered the shop in 2005. The previous owner took a loan from ICICI Bank, and I have the documents. Thinking of buying a 2BHK flat in a new building? The builder is asking for an additional 12 lakhs for a private terrace, but it’s accessible only from your flat and 7 other apartments. In a 200 square yard plot, inherited by two brothers, elder brother (A) and younger brother (B), as per their father’s registered will, brother A receives 175 square yards while brother B receives 150 square yards (at the back). The will states that while brother B can only enjoy the property, he cannot sell it, even after marriage. His wife and he can lease or rent it out, but selling is prohibited. Only their son, if they have one, can sell the property. Our housing society, formed under the Karnataka Apartment Owners’ Association Act, 1972, faces a unique situation. The builder has offered us a vacant flat in exchange for our help in selling the remaining unsold units. This flat was constructed beyond the approved plan, and the builder also omitted promised facilities like open parking and a squash court, using the shared space for these extra apartments. The flat has received Katha but lacks an Occupation Certificate.We have two questions:1. Can our association, which is registered with the Registrar of SD and Properties but not as a formal society, legally own a flat in its name?2.
