We, 200 homebuyers, purchased plots from a developer who promised water, electricity, roads, and a clubhouse, but hasn’t delivered. We have registered our ownership with the 7/12 extract. Now, we’re thinking of taking legal action. Should we form a society or association to fight this? The developer is refusing to give an NOC for society formation. What can we do? Also, if we form a society, can we, through a majority vote at a General Meeting, decide to pool funds to complete the unfinished infrastructure ourselves?

I booked a 3 BHK flat in Noida Extension back in June 2010 for 25 lakhs. I made a payment of 7 lakhs in June 2011. The builder hasn’t started construction of Tower 18 yet, even though it was supposed to begin in 2013. Now they’re sending demand letters. When I asked why they’re asking for more money despite not starting construction as per the payment plan, they said they have the right to send these letters. I invested in a studio apartment at Earth Titanium project and paid the upfront amount, with the agreement that they would pay me a fixed return on my investment until possession. However, since September 2015, they haven’t sent the promised cheques. In January 2016, they emailed stating they couldn’t fulfil the agreed return due to market conditions and offered a 15% discount. I joined a gym in Gurgaon that has a one-month notice period for cancelling membership. In mid-February, due to health problems, I couldn’t go to the gym and decided to stop my membership. I emailed them on March 3rd to cancel, but the email bounced and they only received it on March 7th – a week late according to their policy.
