My grandfather passed away, and his property was sold by his legal heirs (my father and uncles) to a third party 10 years ago. Now, after all this time, my siblings and I are facing legal trouble because our parents are using a pre-decree order they obtained in 1991 to try and claim a share of the property. The court has already dismissed their request for a final decree, and they are now appealing. They are asking for a reallocation of their share, even though the property was sold legally in 1980. We are being dragged into this legal battle, and we are trying to argue that the sale was valid and the property is no longer theirs. My family owns land in Uttarakhand, but the original owner lives in Gurgaon. We were ready to register the property but the office was closed. Since the owner couldn’t travel to Uttarakhand, we went to Gurgaon and got notarized documents from her, including a Power of Attorney. My grandfather bought a property in Uttar Pradesh in 1966 using proper documents. He gave it to a milkman who used it to keep his buffaloes. A few years ago, we asked him to vacate, but he refused. We fought a case in court and won in 2006. We need to execute that order. However, we recently discovered that this land was acquired by the Uttar Pradesh government under the Land Acquisition Act of 1894 in 1972 and handed over to an Improvement Trust. We have a copy of the notification and Land Acquisition papers, but we were unaware of this and were not informed about it until 2016. The compensation of Rs. 220 was not claimed by anyone.1. Our builder created two apartment blocks, D1 and D2, with 54 flats and 54 bungalows in a gated community.
