I worked at a company for three years. From February 1st, 2016, my salary was ₹50,000 per month. I resigned on September 26th, 2016, and worked for two more months, leaving on November 25th, 2016. I haven’t received my salary for September, October, and November. After 45 days, on January 13th, 2017, the company said they’d pay me ₹40,000 per month starting from February 1st, 2016, because I didn’t complete a full year. My current employer hasn’t made me sign any agreement about non-compete clauses, and it’s not mentioned in our employee handbook either. They just tell me my salary without explaining how it’s calculated. So, am I still bound by a non-compete clause? They’re forcing this clause on us because they’re not hiring new people for the Mumbai office. Can you help me understand my situation?

As a pharmacist in a government hospital, I’m the sole person in my role. I worked at EXL Service Private Limited in Noida, Uttar Pradesh, from February 2016 to July 2016. I was terminated in August 2016, with the reason cited as “probation” in the termination letter. The Labor Department, after reviewing my documents, ruled this termination illegal as “probation” does not justify termination under Indian law. My joining letter and salary structure do not mention a probation period, implying my status as a regular employee. I also presented a previous joining letter from 2007, along with experience and relieving letters, which further supported my claim. The HR’s termination letter, however, contradicts this.

I recently joined a new company and they asked me to pay ₹4,500 for training. I paid the money but didn’t get a receipt, as they said the company doesn’t provide them. I asked for a receipt three times, but they kept saying the same thing. I do have a confirmation letter, though.
