My family bought a flat in Hyderabad back in January 2014. Lately, we’ve noticed cracks appearing in the walls, and the borewell’s gone dry. I bought a flat in Jaypee Kosmos in 2011, with a promised possession date of 2015. I’ve paid all installments except the last one, which I cleared two years ago. Since then, Jaypee keeps saying they’re waiting for the Occupancy Certificate from the Noida Authority. These false statements amount to perjury, and I want to file an application under Section 151 to the National Commission to set aside their previous order, which was obtained through fraud on the judiciary. My family and I booked a flat in the Ekdant FNG project in Surajpur, Greater Noida, back in July 2012. We opted for a flexible payment plan and have paid almost the entire amount, except for a small portion of the additional charges. Now, the builder has stopped construction and is selling the construction materials and machinery on-site to settle debts with creditors. He clearly has no intention of finishing the project. The project was originally planned with five towers, each with 14 floors, but the builder has illegally increased the height of Tower A and B to 24 floors without consulting us. He even told the contractor to sell off the remaining materials on-site. I am left with no funds to pay the remaining amount. What legal options do I have? Which court should I approach?
