I purchased a plot in 1997 through a General Power of Attorney (GPA) from a Mumbai-based realtor. The GPA was registered in Hyderabad under the Indian Stamp Act 1899. I have the registered sale deed and paid a stamp duty of Rs. 16,000 for the registration. Multiple plots were registered under the same GPA. The original GPA was not provided to me; I only possess a photocopy. In 2013, local troublemakers forged another sale deed, aided by the Mumbai owner who created a new sale agreement. I filed criminal and civil cases, obtaining an interim injunction in the civil case. The Mumbai owner, when summoned by the court, denied issuing the GPA in 1997, claiming my registration is invalid.An RTI query to the registration office revealed the GPA is untraceable and they are obligated to preserve documents for only 3 years under the 1899 Act, despite the stamp duty paid. Is this accurate? Can you advise on what records from the registration office, or any other document, can prove the GPA was registered? Any other advice would be greatly appreciated.

My father passed away recently. He had no children and nominated his close relative, who has been caring for him and my mentally ill mother, as his heir. We are currently living in a temporary home while our property is undergoing renovation by a private developer. The developer had been paying rent to my father since his property was demolished a year ago. My family has been running a joint business since 1948. In 1964, my father bought a house using income from the family business. My grandfather passed away in 1966. The house was initially registered in my uncle’s name through a power of attorney, and then transferred to my father. A dispute arose in 1972 and was settled through an award in 1973, allocating the house to my father. He challenged the award in court but later withdrew the case in 2007.My question is: does this house fall under ancestral property? Does the pooled family property also constitute ancestral property? Can I claim a share in this property and if so, could I seek a stay order to prevent its sale until my claim is settled?

My family migrated from East Bengal during the Partition in 1947. We received land from the government then, and our current house stands on it. The land wasn’t bought, it was given to my grandmother. My two uncles were working then, so their names were not included in the deed. Only my grandmother, aunt, one uncle, and my father are mentioned. These relatives never lived in the house or paid any taxes on it. My family bought a flat four years ago, and it was supposed to be ready more than two years ago according to the agreement. The penalty for the delay seems to be just on paper. Recently, we received a letter asking us to finish some work in the flat. We’ve been to the construction site three times, but each time, we’re told we can’t see the flat for one reason or another.
