My family has a long-held ancestral property, but my brothers are claiming I have no share based on a forged will. I plan to challenge this will in court and seek a division of the property. My lawyer says both cases can proceed together. I want to file for partition based on the property’s assessed value. I bought a plot in 1998 but haven’t registered it yet. I’ve built a house on part of it, but another part is still empty. The plot is included in the gram panchayat records, I have a house number, and I pay taxes, water bills, and electricity bills. I have all the original documents from the previous owner and a sale agreement on stamp paper from 1998. I also have an ownership certificate from the gram panchayat.How can I register the plot and get a bank loan? Could the previous owner have any legal claims? If they filed a case, would it be valid?

I’ve been living in Australia for the past two decades, moving there when I was 32. Before that, I lived with my father in India. He’s now 81 and has divided his agricultural land among my brothers. For the last 20 years, I’ve been sending him money, which he saved and used to buy a 2-acre plot of land in Tamil Nadu this year (June 2016). He’s written a will stating that I, his eldest son, will inherit the land after he passes away. He’s also had a Power of Attorney drawn up for the property in my name. My question is, will I be able to inherit the land despite it being purchased recently in his name? What are the legal steps I need to take to inherit it? How can I get the title transferred to my name after his death? Any guidance you can provide would be greatly appreciated.

My family and I are Hindus. I, the elder brother, registered a property settlement deed with my younger brother for my land. The agreement stated he’d get ownership of the first floor after repaying my loan, but in the meantime, I let him build his house there. However, after some time, he began mistreating me and my wife.I live in Hari Nabi and registered the deed at ADSR Sonarpur. He pressured me to sign some papers, claiming they were just consent forms. My father was involved and threatened that if I didn’t sign, he would tell my boss I wasn’t caring for our parents, putting my son at risk. Scared, I signed.Now, I’m worried these papers could be a Power of Attorney (POA), giving him control over the original registered settlement deed. Our society’s redevelopment project faced delays, and now the builder has changed the plan without our consent, increasing the carpet area and altering the flat’s location.
