My wife and I got married in January 2013 and she came to Canada in May 2014 on a spousal visa. She stayed for about 8 months and then went back to India in February 2015, saying her mother was ill. But she stopped contacting me after that. It’s been almost two years (March 2017) since she left. I’m now a Canadian citizen, but I want to get a divorce in India based on desertion so I can remarry. My builder in Noida has asked for the final 60% payment for my flat bought under a 40:60 payment plan. However, they haven’t given me possession yet, and the Occupancy Certificate (OC) hasn’t been issued. They’re promising possession and the OC after I pay, but I’m worried because I chose the 40:60 plan to avoid this risk. They’re also threatening penalties if I don’t pay. What are my options? Should I send a legal notice or go to the consumer forum/Noida Authority? Will I have to pay penalties if I don’t pay the final amount? Can the builder demand the final payment without offering possession or the OC? I’m really concerned.

I’ve filed an RTI and appeal with the UP Technical University (UPTU) Registrar in Lucknow to view my answer sheet, but haven’t received a response in three months. Living in Noida, it’s difficult to travel to Lucknow. What can I do to get my answer sheet and have it re-evaluated?
