My wife and I have decided to get a divorce under Section 13B of the Hindu Marriage Act. We’ve agreed to settle the terms, including returning gifts or a sum of money. How can I legally return this money to ensure there’s no dispute later? Also, is there a legal way to avoid paying alimony and maintenance after our mutual divorce? I understand we can sign an agreement, but I read a case where the court said such agreements might not stop someone from claiming alimony under Section 25 or maintenance under Section 125 of the Hindu Marriage Act. My husband’s case is being heard in the trial court under Section 12 1(a) regarding impotency. The court ordered a potency test at AIIMS Delhi. The doctors’ report states he doesn’t have erectile dysfunction and is capable of sexual intercourse under normal conditions. However, they also mentioned psychological reasons for non-performance, as often seen in marital issues, can’t be ruled out. Given this report, can I still seek annulment of our marriage? My wife left home after a fight a few days ago. We filed a Section 9 case but she hasn’t appeared in court. I was called to the CAW cell today, and they accused me of many things, putting immense pressure to take her back. They even threatened jail. I can’t live with all these false accusations, so I told them I wouldn’t. If she wants to come back, she can do it through the court proceedings. However, the CAW cell is still pressurizing me.
