My Intellectual Property case filed in Tirupati Civil Court in 2009 was dismissed in December 2016 because I hadn’t filed my income tax returns. I had given three blank cheques to someone in 2008, but the accounts are now closed. If they try to deposit these cheques, could they file a cheque bounce case against me? I’m owed ₹10 lakhs by a person who has passed away. He had signed cheques from a joint account he shared with his son. The Magistrate dismissed my cheque bouncing cases, claiming the signatures on the cheques were not his. However, the account was a joint one, meaning both father and son could operate it. Namaste Sir,I’m in a bit of a bind. Two years ago, someone gave me two cheque leaves worth around one lakh rupees. Unfortunately, they bounced, and I’m having trouble reaching the person. I’ve tried sending legal notices three times, but they’ve been returned as undeliverable because he refuses to accept them and I don’t have his current address. I gave a cheque as security in 2015 and paid the amount in cash. However, the person presented the cheque and it bounced. I stopped payment on the cheque before it bounced. No case was filed for two years, but a police officer has been calling me for the past five days demanding I visit the police station, threatening an FIR if I don’t. My builder gave me a cheque for Rs. 4 Lakhs as a refund, but it bounced. I sent him a legal notice within a month, as required. He didn’t respond within 15 days, so I had to file a case within 30 days. Unfortunately, I missed that deadline. However, the cheque is still valid. Can I deposit it again and if it bounces, serve him a fresh notice? Will the court consider this second notice even though I already sent one before? I’m worried about what to do next. My husband owed someone 2.45 lakhs, but we never actually received this money. The lender was putting pressure on us, so we agreed to pay back 20 thousand rupees each month. We started paying in December 2014. He collected 13 blank cheques from us, promising to only withdraw 17,000 rupees each time and to not write the amount on the cheques. My husband signed the cheques and filled in the payee’s name. We finished paying the entire amount in January 2016, leaving one cheque with him. We called the bank and cancelled that cheque. To our shock, he deposited the cancelled cheque yesterday for 13,000 rupees. The bank returned the cheque due to a “stop payment” instruction. Can we file a case against him for cheque bouncing?
