A partnership firm, ‘RR’ and ‘BB’, faced financial difficulties in 2010. ‘BB’, a borrower and guarantor using his property as collateral, passed away in 2014. The authorities instructed the bank to serve all of ‘BB’s’ heirs with a notice regarding the recovery of the debt, following principles of natural justice. The bank served the notice on ‘SS’ and another heir, ‘MM’. ‘MM’ claimed the property belonged to a Hindu Undivided Family (HUF) and not ‘BB’, securing a court order preventing ‘SS’ from selling or transferring the property. This order was also served on the bank. Despite ‘SS’ presenting a will claiming ownership of the property, the bank, allegedly in collusion with ‘SS’, did not auction the property but instead settled the debt in two parts: one labelled as an “out-of-court settlement” and another as a “private treaty” involving only ‘SS’ and ‘RR’, ‘SS’s’ wife. The private treaty document only mentioned ‘SS’ and ‘RR’ as signatories, leaving out the buyer’s identity. Another document, signed by ‘RR’, purported to sell the property to the buyer. The private treaty agreement is questionable.

My family has owned land in Survey Number 42 since 1936. Another family bought their portion in 1940. Back then, there were no separate sub-numbers for the land. In 1944, the other family went to the District Collector to get their part of the land officially recognized. The Collector then divided the entire survey into sub-numbers 1, 2, and 3, but they mistakenly ignored our family’s ownership. We can’t claim our land now. Can we challenge this decision now that I learned about it through an RTI application?

My marriage in 2014 turned into a nightmare. My in-laws constantly nag and criticize me, making life unbearable. My mother-in-law has a strong hold on my husband, who blindly agrees to her demands. She constantly stirs up trouble and lies to him for trivial matters. My husband, currently in Australia, isn’t a permanent resident and constantly asks me for money for his settlement, a huge sum like 8 lakh rupees. My in-laws, including his mother, two sisters, their husbands, and children all live together, making the situation worse. They harass me daily, even throwing me out of the house in December 2014. I’ve been living with my parents for the past five months. My husband came to my parents’ home and promised to take me back, but he left for Australia without my knowledge, and now he and my in-laws have filed a case against my family and me, accusing us of demanding property. He doesn’t contact me, send me money, and my father, a heart patient, is under immense stress because of the constant legal summons. We can’t afford legal representation, and I’m terrified and emotionally drained. I need help, I feel utterly helpless.

Our Tuticorin warehouse is leased to a cargo handling agent. A shipment was stored there, but the importer never came to collect it. The agent paid rent for a year but hasn’t paid anything since. Six years have passed, and we filed a lawsuit in Madurai to have the goods auctioned or abandoned. They’re about to be auctioned.
