We bought a large Panasonic TV from Samrat Electronics in Kalina, Mumbai, three years ago. Within a week, the TV developed a problem and the company replaced it. The same issue reappeared a few months later, and we received another replacement. Now, after a year, the problem is back, and Panasonic wants â‚¹20 lakhs for a smaller replacement. I ordered two items from Spa Ceylon online on December 2nd, 2016. One was discounted, while the other was inexpensive. I paid online. The next day, a Spa Ceylon representative called to say the low-priced item was actually more expensive due to a website error. They offered to cancel that item and send only the discounted one. After some discussion, I agreed but asked for a credit note for the extra amount paid. On December 7th, I received only the discounted item, and it was expired. I contacted Spa Ceylon about this and the issue with the credit note. A female executive informed me that discounted products often come close to or past their expiry date. I challenged this and requested a replacement, but she said she’d have someone call me back. What should I do if I don’t get a replacement, and what about the cancelled product?

My husband’s case is being heard in the trial court under Section 12 1(a) regarding impotency. The court ordered a potency test at AIIMS Delhi. The doctors’ report states he doesn’t have erectile dysfunction and is capable of sexual intercourse under normal conditions. My family faced a tough situation when our loan was declared a non-performing asset (NPA) and the bank served us a 13(2) notice. We submitted detailed objections, spanning 48 pages, to the bank. Unfortunately, my mother fell critically ill during this time, so I requested the branch officials to visit her and collect the documents. The Branch Manager received the copies and I even handed over copies for the Chief Managing Director (CMD) and the Account Officer (AO). Despite this, the bank issued a 13(4) notice and the case went to the Debt Recovery Tribunal (DRT). During the proceedings, the bank’s lawyer acknowledged receipt of our objections but argued that since they were given to the Branch Manager instead of the AO, no reply was provided. We, however, believe that the SARFAESI Act of 2002 clearly states borrowers can submit their objections to either the Secured Creditor or the AO, while the reply should only come from the AO. As the loan agreement was signed with the bank manager, who is the representative of the secured creditor, handing over the copies to him shouldn’t be considered wrong. We believe this case should be revisited due to the bank’s failure to respond to our valid objections.
