My friend was accused of criminal breach of trust under Section 406 of the Indian Penal Code. The person who filed the complaint, however, got back their property without telling the police or the court while the case was still ongoing. Can this be considered an out-of-court settlement? My wedding took place on the 26th of June, 2012, following Hindu customs. We have a 4-year-old son named Aavik. Sadly, I’ve been separated from my husband and in-laws since the 15th of April 2016. I filed a case against them in the Saket court, but despite my need for maintenance, the court keeps postponing hearings. My husband even tried to kill me, and I filed a police report, but he was granted bail. I also reported the incident to the Kirti Nagar Women’s Cell, but again, he was released. Despite having all the evidence, I haven’t received justice. My husband and in-laws still hold my dowry and other belongings. They pressured me to sign property documents, fearing I’d claim the house if anything happened. I did it for the sake of our marriage and son. They used to take my entire salary and then made me quit when they had enough. Now, my husband has filed for divorce, refusing to live with me or to let me see our son. I don’t want to divorce him or be separated from my son because I’m fighting a domestic violence case against them. What can I do in this situation? I retired from my bank job in December 2015. Unfortunately, I fell ill and couldn’t return to work in Tinsukia, Assam. My husband is struggling with addiction. He’s losing himself and I’m desperate to help him get clean. I’m thinking about calling the police, but I only want him to stay in jail long enough to detox from the drugs.
