Is it truly necessary to resort to legal action under sections like 24, 25, 125, and 498 A of the Hindu Marriage Act for protection? This question arises as a case has been filed against someone under section 12 of the Act based on epilepsy and its non-disclosure. As we understand, since December 2009, section 5 of the Act has been amended, making epilepsy no longer a valid ground for divorce. Furthermore, the non-disclosure of such a condition doesn’t seem to justify a divorce under any other section of the Act. We’d appreciate a quick response on this matter.

I got married nine months ago, and my life has been a nightmare since. My husband drinks excessively, smokes, and has other bad habits that he hid from me and my family before our wedding. He’s also abusive, encouraged by his family who constantly demand dowry and provoke him to hit me. I’m from Haryana and work in Jammu, where I’ve lived since May 2016. My wife is staying with her family. My father is in a government job in Haryana and is retiring in January 2017. I’m currently paying interim maintenance in a Section 125 case in the lower court. However, I’ve lost my job and need to appeal for a revision of this maintenance under Section 127. My wife’s cross-examination wasn’t properly conducted, so I need to request a recall of witnesses under Section 311. Also, I can’t see my 6-year-old daughter, so I want to appeal for custody under Section 8. Is there a way to file a petition within the main Section 125 case itself to reduce my financial burden, ideally during my working hours?
