I recently paid a token amount (bayana) to buy a property, but my loan application has been rejected because of a missing document. The seller can’t provide this document, and the agreement deadline is just a week away. I’ve been trying to reach him for over 10 days, but he’s not responding.I’m worried I won’t get my token money back. What legal steps can I take? What kind of messages or calls can I send to document the situation, in case I need to take legal action? My builder gave me a cheque for Rs. 4 Lakhs as a refund, but it bounced. I sent him a legal notice within a month, as required. He didn’t respond within 15 days, so I had to file a case within 30 days. Unfortunately, I missed that deadline. However, the cheque is still valid. Can I deposit it again and if it bounces, serve him a fresh notice? Will the court consider this second notice even though I already sent one before? I’m worried about what to do next.
