My father passed away in January 2013, and I’m the legal heir to his property. He had a joint bank account with his daughter-in-law (my eldest brother’s wife) opened in 2009 under an “Either or Survivor” mandate at a major private bank. My family and I have been living in our flat for over two decades, ever since my father was allotted this plot by the Mathura Development Authority. I gave a token amount by cheque (made out to the owner) to an agent for a flat in Mumbai. The owner is currently in the UAE. I decided to cancel the deal within three days of giving the token money, informing them through WhatsApp. However, there was no formal agreement or contract outlining the payment schedule or receipt of the token money. He was later transferred, but he added Section 308 in the case diary, favoring the accused, even though their complaint was only accepted by the court.
