My father owns a plot where we’re planning to build a 3-storey house. My brother and I will each get a floor after construction, with me also giving him my shop in exchange for his floor. I want to ensure my brother legally agrees to register his floor in my name after construction. Can we register the floors before they are built? If not, what other steps can I take to protect my rights?

Under Indian law, you cannot register the floors before construction as they don’t physically exist yet. You can however draft a legally binding agreement outlining the ownership division and the exchange of the shop for the floor. This agreement can be registered with the sub-registrar to ensure its legal validity and enforceability.
