My aunt got married in 1972. To help her, our grandfather gifted her an acre of land in 1974 and sold another half acre to repay her wedding loan. Later, she sold the gifted acre to someone else, and we have the registration and sale documents. Now, she’s filed a case against us, claiming my brother controls all our family assets, my father didn’t give anyone a share before passing away, and my brother benefits from the land. How can we claim our share of the property?

Your aunt’s claim is based on inheritance, not the land sale. Since your father passed away without a will, his property will be divided equally among his legal heirs, including your aunt, under the Indian Succession Act. You need to file a suit for partition of your father’s property to claim your share. The land sale is irrelevant to the inheritance claim.
