I bought a flat in 2015 with a promised delivery date of October. Construction is finished, but I still haven’t gotten possession. They say they’re waiting for a government certificate that will take another 2-3 months. Also, they changed the toilet fixture from what was in the brochure, and won’t fix it. What should I do if I want to file a case in consumer court? Should I wait to get possession first?
Best Answer
You can file a case in the consumer court even before getting possession. You can seek compensation for the delay in possession and the change in toilet fixture, as these are breaches of contract. Consider sending a legal notice to the builder demanding possession and rectifying the fixture before filing a formal complaint.
