Section 424 of the Code of Criminal Procedure, 1973 (CrPC)

2. Explanation:

Section 424 of the CrPC empowers a court to suspend the execution of a sentence of imprisonment for a specified period, subject to certain conditions.

This provision is designed to provide relief to convicts facing imprisonment while allowing the court to maintain control over the situation. It is often applied in cases where the convict is:

  • Suffering from a serious illness
  • Pregnant or lactating
  • A minor
  • Having a family dependent on them

3. Illustration:

Imagine a woman convicted of theft is sentenced to six months’ imprisonment. During the hearing, the court learns she is heavily pregnant and has no family to care for her young child. Under Section 424, the court may suspend the execution of the sentence until after she delivers her child, provided she complies with certain conditions set by the court (such as regular appearances and good behavior).
