Supreme Court Orders Construction Of Inclusive Toilets In Court Premises

The Supreme Court orders construction of toilets for women, specially-abled persons, and transgender individuals on January 15th in court premises and tribunals nationwide. A bench of Justice JB Pardiwala and Justice R Mahadevan delivered the judgment in a petition filed by Rajeeb Kalita in 2023.

SC Mandates Inclusive Toilet Facilities


The Court instructed all States, Union Territories (UTs), and High Courts to ensure sufficient funds for building and maintaining toilets. These facilities must include separate washrooms for litigants, lawyers, and judicial officers. The judgment emphasized periodic reviews in consultation with committees constituted by the High Courts.


Justice Mahadevan announced that a status report on compliance must be submitted within four months. Justice Pardiwala warned of contempt action for non-compliance.


Key Directives Issued By The Supreme Court


Construct toilets for men, women, and transgender persons.
Ensure proper maintenance and cleanliness of all facilities.
Provide separate toilet facilities for litigants, lawyers, and judicial officers.
Install sanitary napkin dispensers in women’s toilets.


Background Of The Case


The Supreme Court had earlier expressed concerns about inadequate toilet facilities, even for female judicial officers. In November 2024, the bench reserved its judgment after seeking updates from High Courts regarding existing facilities.
The Court has now directed the Chief Secretaries of all States/UTs and Registrar Generals of High Courts to ensure strict compliance with the order.
