How To File A Case In The Supreme Court Of India

To file a case in the Supreme Court of India, follow these steps.

  1. Hire a lawyer: Filing a case in the Supreme Court requires a lawyer, as the Court does not allow individuals to represent themselves. You can search for a lawyer who specializes in the area of law that your case falls under.
  2. Draft a Special Leave Petition (SLP): The SLP is the primary document that needs to be filed in the Supreme Court. It is a request to the Supreme Court to grant permission to hear the appeal. The petitioner should include case details, legal issues, appeal grounds, and relevant information in the SLP.
  3. File the SLP in the Supreme Court within 90 days of the judgment or order. You or your lawyer can submit the filing in person. The filing fee varies depending on the nature of the case.

  1. Serve notice to the other party: After filing the SLP. Serve a copy to the other party through registered post or a process server.
  2. Wait for a response: After receiving the SLP, the Supreme Court may issue notice to the other party asking them to respond. If the Court is satisfied with the petition, it may grant leave to appeal.
  3. Prepare for the hearing if the court grants leave. The petitioner must gather evidence, prepare arguments, and respond to any questions during the hearing.
  4. Attend the hearing: On the day of the hearing, the petitioner must attend the Court along with their lawyer. The Supreme Court will hear both parties and make a decision based on the merits of the case.
  5. Judgment: After hearing the arguments, the Supreme Court gives its judgment. The judgment may be in favor of one party or the other or may dismiss the case.
