If the builder loses the case, the worst-case scenario is that the ownership of the land and the apartments could be transferred to the rightful owner. This could lead to you being evicted from your flats and losing your investments, as the sale deed might be deemed invalid. While you have been living in the flats for nine months, this doesn’t guarantee your continued ownership if the builder’s title to the land is challenged successfully.
