My wife is from Madhya Pradesh. Her father passed away in 2004, leaving behind his property in her mother’s name. She has two brothers, and the elder one is refusing to allow her mother to transfer the property to my wife. Can my wife claim a share in the property and file a case to help her mother transfer it?

Yes, your wife can claim a share in the property. Under the Hindu Succession Act, 1956, she is entitled to a share of her father’s property, even if it is registered in her mother’s name. She can file a case in court seeking partition and transfer of her share from her mother.
