My mother inherited ancestral agricultural land near Nagpur from her father. Her name is on the 7/12 extract (satbaara). Currently, my uncle (her brother) is renting the land for farming. My mother wants to divide the land equally among her siblings and sell her share. What’s the legal procedure for this division? If my uncle refuses to cooperate, what legal options does my mother have?

Your mother can initiate a partition suit in the civil court, seeking division of the land among siblings based on the 7/12 extract. If your uncle refuses to cooperate, the court can order a survey, appoint commissioners, and ultimately divide the land. Your mother can then sell her share independently after the partition is complete.
