My husband passed away three years ago. Our apartment is registered in my mother-in-law’s name and my husband’s. We received the building’s occupancy certificate last year. After his death, my mother-in-law has not allowed me to live in the apartment, and we are estranged. Can they remove my husband’s name from the ownership documents without my consent now that they have received the occupancy certificate this month, especially after showing his death certificate?

Your husband’s name cannot be removed from the ownership documents without your consent. You are entitled to inherit your husband’s share of the property as his legal heir. The occupancy certificate does not change the ownership rights, and your mother-in-law cannot unilaterally remove your husband’s name from the documents.
