My father passed away in 2008 without leaving a will. The society where we live is asking for a clear heir, but they’re not recognizing my brother as the joint holder. We are four siblings – three brothers and a sister. The society insists we settle this amongst ourselves, but my sister is refusing to cooperate. This issue has been dragging on for the past 8 years.

Under Indian law, in the absence of a will, your father’s property would be divided equally among his legal heirs, which includes you and your siblings. The society cannot insist on a single heir and should accept the legal heirs as determined by law. You can approach a court to resolve this matter and obtain a legal declaration of your inheritance rights.
