My father passed away 20 years ago without leaving a will. His property went to my mother, who also passed away 9 years ago without a will. One of my brothers registered a portion of the property during my father’s lifetime, and now he’s managing the entire property. We are 4 brothers and 1 sister, all married. How can we legally divide the property, and does my sister have any rights?

As your father died intestate, his property was inherited by your mother. Since she also died intestate, the property would be divided equally among all five siblings under the Hindu Succession Act. Your brother’s registration during your father’s lifetime may be contested, and your sister has equal rights to the property.
