My family migrated from East Bengal during the Partition in 1947. We received land from the government then, and our current house stands on it. The land wasn’t bought, it was given to my grandmother. My two uncles were working then, so their names were not included in the deed. Only my grandmother, aunt, one uncle, and my father are mentioned. These relatives never lived in the house or paid any taxes on it. Could they still claim ownership of the property, even though it was not originally my grandparents’?
Best Answer
Indian law recognizes the concept of adverse possession, where someone can claim ownership by openly possessing land for a specified period. However, the relatives in this case may not be able to claim ownership as they never possessed the property or paid taxes. The ownership would likely remain with the individuals named in the original deed.
