My family has been renting out a commercial property in South Mumbai for the past 8 years under the ‘pagdi’ system. In 2012, a builder approached us for redevelopment. He promised to pay monthly rent for temporary accommodation until our new commercial space was ready, and we even signed a registered agreement. Initially, he issued a year’s worth of rent cheques, but after that, he stopped paying, claiming financial difficulties. This has been going on for three years now. I’m worried about losing our ancestral property. Is there any way to regain possession of our rightful commercial space and ensure a fair outcome?

Since the builder breached the registered agreement by failing to pay rent, you can file a case in a civil court seeking specific performance of the agreement, including regaining possession of your property and compensation for the unpaid rent.
