I bought a plot in Hyderabad back in 1973 and registered it in my wife’s name. Years later, in 1987, she gave me a full power of attorney, allowing me to sell the property without any time limit. Sadly, my wife passed away recently, and I’m getting old. I want to sell the plot, get a good price, and use the money for charitable work and for my children. But to my shock, I found out that my daughter and her husband, along with my son, cancelled the deed and registered the plot in their names. They are well-settled with their own properties. This happened without my knowledge. Can I do anything to protect my rights and claim the property?

As per Indian law, the power of attorney given to you by your wife does not automatically transfer ownership of the property to you. While your wife’s death has revoked the power of attorney, the property remains registered in your daughter and son’s names. You can challenge the registration based on the claim of fraud and lack of consent, but the outcome depends on the specific details and evidence available.
