Hi,
My family booked a flat in JP Nagar back in October 2015 and paid a 15 lakh booking amount via cheques. We have all the receipts. Sadly, a personal tragedy occurred, and we had to withdraw from the project. The builder initially agreed to refund the amount, but it’s been over a year, and he hasn’t returned the money. We recently discovered he sold the same flat to someone else.
We are considering legal action. What are our chances of winning the case? Any advice would be greatly appreciated.
Thanks,
Vidhya

You have a strong case based on the builder’s breach of contract and misrepresentation. The builder’s refusal to refund your booking amount after selling the same flat to another buyer is a clear violation of the agreement. You should consult a lawyer immediately to file a legal case for recovery of your booking amount with interest and compensation for the builder’s breach.
