Under Indian law, you have a strong case for eviction. The tenant’s death triggered a legal termination of the lease agreement. You should file an eviction suit in court, seeking possession of the shop. Provide proof of the lease, non-payment of rent, and subletting, and you’ll have a good chance of success.
