I was working as a senior resident at a North Delhi Municipal Corporation hospital in Delhi. I was on contract for 90 days, starting on May 13, 2016, and my contract was renewed several times. However, during my last tenure, which began on November 9, 2016, and ended on February 5, 2017, I applied for maternity leave on January 3, 2017, with the leave starting on January 16, 2017. Instead of getting my maternity leave, my contract wasn’t extended, and I was relieved from my duties. Can you please advise me on how to proceed?

Under the Maternity Benefit Act, 1961, you are entitled to 26 weeks of maternity leave. The termination of your contract during your maternity leave period could be deemed illegal. You can file a complaint with the Labour Commissioner or seek legal advice to explore options like reinstatement, back pay, and compensation for wrongful termination.
