I took maternity leave from September to November, following our company’s 3-month paid policy. After that, I extended my leave for another 3 months, which was approved. When I returned in March, they said there’s no work and want to terminate me, or reduce my salary if I take on other tasks. Is this fair? Can I fight this? Are there any laws protecting me in this situation?
Your employer cannot terminate you simply because there is no work available after your extended maternity leave. This is considered unfair termination. The Maternity Benefit Act, 1961, provides protection to women during and after maternity leave. You can consult a lawyer to explore legal options for fighting this unfair termination.
