My grandfather passed away in 1992, and since then, my mother’s brothers have been manipulating us with a fake will. They forged it, obtained a succession certificate, and took control of our family’s valuable property. They even sold it and withdrew large sums of money from bank accounts. Should I file a case against them first, or focus on getting an investigation registered? I’m considering filing a criminal case under Section 420 and freezing their accounts. What would you advise?

You should first file a police complaint alleging forgery, fraud, and misappropriation of property. Based on the investigation, you can then explore filing a civil suit to challenge the fake will and reclaim your rightful share of the property. Simultaneously, you can also pursue a criminal case under Section 420 of the Indian Penal Code and seek to freeze their accounts.
