My fiancée and her family are caught in a false 498A case. Her family is in Bhavnagar, but she was studying in Surat during and after her brother’s marriage. She never lived with her sister-in-law, yet her sister-in-law filed a case against the entire family. I live in Canada and want to bring my fiancée here urgently. Some say she can’t get a passport due to the case. Is this true? If not, how can she get a passport? How can we remove her name from the case? Any advice would be greatly appreciated. Thanks, Ravi.

It’s not automatically true that your fiancée cannot get a passport due to a 498A case. She can apply for a passport and provide supporting documents like a police clearance certificate and a statement explaining her situation. Consult with a lawyer in India to explore legal options for removing her name from the case and getting legal assistance for her passport application.
