Yes, under the Hindu Marriage Act, you can legally file for maintenance from your husband even without seeking divorce. The court can order him to provide monthly support considering his income, your needs, and your son’s needs. It’s advisable to consult a lawyer for specific advice based on your individual circumstances.

My father tried desperately to reconcile things. In September 2015, another letter arrived, this time accusing me of being incapable of basic tasks like bathing and dressing myself. Given these circumstances, can I file a defamation case for the insults, a cheating case against my husband for breaking his promises, and a divorce? What evidence would I need to support these legal actions?
