Family Matter in India – Scenario 1:The court initially decided on a monthly maintenance of Rs 5,000 for my wife. Now, her lawyer is requesting a significant increase to Rs 18,000. Can this be legally challenged? Scenario 2: My wife is demanding a large sum of money and a share in my property for an out-of-court settlement. This is not feasible. What legal options do I have to resolve this situation? Can I remarry? Should I file for divorce? Scenario 3:Is it legal to gift my property to my two sons from my ex-wife, who is still living with me?

In Scenario 1, you can legally challenge the increase in maintenance if you can demonstrate it’s not justified based on your wife’s needs and your financial capacity. Scenario 2 allows you to negotiate a settlement or file for divorce, but remarriage is not legally restricted by a pending settlement. Scenario 3 – Gifting property to your sons is legal, but your ex-wife may have legal claims on the property if there’s no pre-nuptial agreement.
