Dear LR Team,
I’m writing to seek clarification on a matter that isn’t covered in your website’s blogs or FAQs. I’m buying a resale apartment in a society registered under the Karnataka Apartment Ownership Act. The association has demanded and collected a transfer fee, citing their registered bye-laws.
However, I understand that this fee is usually levied by cooperative housing societies, who handle title documentation. In group housing societies, this responsibility falls on the authorities and the Registrar. Could you please clarify if this transfer fee is legally valid in my case?

The Karnataka Apartment Ownership Act does not explicitly mention a transfer fee. However, if the society’s registered bye-laws, which are legally binding, include a provision for a transfer fee, it is likely considered valid. It is advisable to consult a lawyer to verify the legality and scope of the transfer fee in your specific case.
