Respected Sir,
My elder brother received 3 acres of land as a gift from the village headman (gouda) when he was 5 years old. Now, we are trying to divide our shared property, but he refuses to include this land. I was 2 years old at the time the gift was given. Can I legally claim a share of this land through a court case?
Sincerely,
Siddu

Under Indian law, a minor cannot accept a gift, so the land title would likely vest with your brother’s guardian. As you were also a minor, you might have a claim to a share of the land. However, the specific laws and your claim’s validity will depend on the state where the land is located and the details of the gift deed. It is recommended you consult with a lawyer for legal advice.
