Our society in Andheri, Mumbai recently held elections for the new Managing Committee. We have a couple of questions about the results:
– Three committee members haven’t lived in the society for the past 5 years. Is their appointment valid?
– Can a husband and wife, owning separate flats, both be on the Managing Committee?
Please provide the relevant sections of the society’s rules and regulations, as well as any legal advice on the validity of these appointments. If either appointment is considered invalid, what steps can be taken to address the situation?
Best Answer
The validity of the appointments depends on your society’s specific rules and regulations. Generally, residing in the society for a minimum period is a common requirement for committee membership. Regarding a husband and wife serving on the committee, there is no legal bar, but the society’s rules may have restrictions on family members holding positions. To address any invalid appointments, you can approach the society’s management or file a complaint with the Maharashtra Cooperative Societies Act, 1960.
