Our family owns a 70-year-old building in Mumbai with 7 apartments, all rented out for years. The current rent is very low, around ₹350. We’re wondering if we can legally ask the tenants to vacate now. The building is in our grandfather’s name, and we want to know if we can divide it among his children, including our share of one apartment.

Under Indian law, you cannot legally ask tenants to vacate a property solely to increase rent or for personal use unless there are specific grounds for eviction as per the Rent Control Act. The building can be divided among your grandfather’s children, including your share, but the rights of existing tenants, as per the Rent Control Act, remain protected.
