Our family has a piece of land that has been in our family for generations. My mother passed away when I was young, and my father later remarried. We have two brothers and three sisters, and my stepmother has a son. We’re all working hard, and when we come home on leave from our jobs in the Navy, my father won’t let us enter our own home. My brother and I loaned my father and his step-son money for an agricultural loan, and we have a written agreement that we’d receive a share of the ancestral land in return. We’ve fulfilled our part of the agreement, but now my father refuses to give us what we’re owed. What legal options do we have to claim our rightful share of the land?

You can file a suit for specific performance in a civil court to enforce the written agreement with your father. You can also claim your share of the ancestral land as per the provisions of the Hindu Succession Act, 1956, by filing a partition suit.
