Our family has a large ancestral home, built in 1947, passed down from my great-grandfather. He left it to his four sons, including my grandfather. For the past 40 years, each brother has lived in a separate part of the house, with individual electricity and water bills. My parents are looking to sell this home and move elsewhere, but my grandfather’s brothers are unwilling to cooperate. Indian law recognizes the right of co-owners to sell their share of joint property. If your parents have a clear ownership share and can prove their long-term occupancy and contribution, they can approach the court for partition of the property and subsequent sale, even if other co-owners object.
