Namaste! I own a corner plot house in our society, which is a freehold property. I’m planning to convert it into a commercial space. The front of my house borders a 7.5-meter road within the society, and the back connects to a 7.5-9 meter road owned by the apartments behind. This road ultimately connects to a 24-meter main road.
I have two questions:
1. What role does our society association (it’s not a registered cooperative society) play in granting an NOC for converting my residential property to commercial?
2. Can the society object to this conversion even if I haven’t made any changes to the property and it was originally allotted as a residential plot by the builder?
Your insights would be greatly appreciated! ðŸ™

In India, the role of a society association in granting NOCs for residential to commercial conversions is not defined by law. However, they often have a significant influence due to their control over internal affairs. The society can object to the conversion based on the original allotment conditions and the potential impact on other residents, even if no changes have been made to the property.
