My son recently purchased a flat with a bank loan, and I’m listed as a co-owner on the documents even though I didn’t contribute financially. The flat is registered, and we have possession. Now, my wife wants to buy a parking space for the flat, and she’s paid for it in full. She wants to register the parking space either jointly with my son or with me, since one of us is a co-owner of the flat. However, the flat vendor is hesitant, claiming it might not be legally allowed and that only flat owners can own the parking space. What’s the legal advice in this situation?

Under Indian law, a parking space can be registered separately from the flat. As long as your wife has paid for the parking space, she has the right to register it in her own name or jointly with you or your son, regardless of whether you are a co-owner of the flat. The flat vendor’s statement is incorrect and legally unfounded.
