My parents owned a flat in Mumbai, but they’re no longer with us. There are four of us siblings, and two were named as beneficiaries in the property documents. We can’t agree on how to divide the flat. I want the court to decide each person’s share and then sell the flat, dividing the money fairly among those who are entitled. What’s the best way to go about this?

You can file a Partition Suit in a civil court in Mumbai. The court will determine the share of each sibling based on the property documents and the law of intestate succession. After determining the shares, the court can order the sale of the flat and equitable distribution of the proceeds.
