My mother and I don’t want any share in our family house, which we only have an allotment letter for. We want to divide it equally between my two brothers. However, my younger brother refuses to give any share to my elder brother and won’t sign the property distribution papers. Is there a legal way to resolve this situation? Can the court force my brother to sign the papers? Or, can the house be registered in my mother’s name without needing my brother’s signature?

Yes, you can approach the court to resolve this situation. The court can intervene and order the younger brother to sign the property distribution papers. However, registering the house in your mother’s name without your brother’s consent might not be possible as his signature is required for the transfer.
