My in-laws owned a shop. My father-in-law registered a property in my mother-in-law’s name in 1988. They had 5 children at the time, but no consent was obtained from any of them. Both my in-laws have passed away. Last year, in 2015, my mother-in-law transferred the shop to my brother-in-law and his son, half each, without any consent from the other children. Can we challenge this property transfer in court?

Yes, you can challenge the property transfer in court. Under Indian law, a property transfer without consent from all legal heirs is considered invalid. As you and your siblings are legal heirs, you have grounds to file a suit for partition and challenge the transfer based on lack of consent.
